Terms & Conditions
1. As a committed member on my membership agreement, my fee will remain unchanged for the duration of my membership.
2. To terminate my membership with MADFIT MMA, I understand that I am required to provide a written notice of two months (60 days). If I terminate my membership and wish to rejoin, I will be held liable to pay the registration/admin fee again.
3. I acknowledge that I am responsible for monthly payments even if I or my child(ren) do not attend classes. Members who have signed the membership agreement must comply with the conditions outlined in the agreement.
4. PAUSING OF CONTRACTS – Injury or Illness. In the event of sustaining an injury or illness supported by a medical certificate, and if the expected recovery period is one calendar month or longer, my membership will be frozen at a rate of R150 per month.
5. PAUSING OF CONTRACTS – Should I wish to pause my membership for reasons other than illness, such as a holiday, with an absence of at least one calendar month, my membership will be frozen at a rate of R250 per month.
6. I understand that there are only two available payment arrangements: monthly via recurring direct Debit Order, or 3/6/12 monthly non-refundable advance payments via cash, card, or EFT.
7. Membership fees, including VAT, are payable monthly in advance and may be subject to an annual 10% increase.
8. If my Debit Order fails, I acknowledge that I will be held liable for an additional 10% administrative penalty.
9. Failed monthly payments remaining unpaid by the last day of the applicable month will be forwarded for collection, and additional collection charges may be incurred.
10. Repeated failures will result in termination of the Debit Order arrangement and implementation of a minimum of three monthly non-refundable cash advance payment arrangements.
11. MADFIT MMA will operate on a reduced schedule during the December period and will be closed for part of the month. Specific dates, times, and schedules will be confirmed in November.
12. I understand that I am responsible for monthly payments during the Christmas and New Year period, and the same rule applies for termination of membership during this period.
13. I am aware that MADFIT MMA exercises and training are physically demanding. I affirm that I am physically and mentally fit to participate in Martial Arts/Workout instruction and free from any communicable/infectious diseases that may endanger my health or the health of other members.
14. MADFIT MMA training may involve sparring and physical contact with others, which can result in personal injury (both mental and physical) or death. I agree to defend, indemnify, and hold MADFIT MMA, its directors, officers, employees, and other related parties harmless from any and all actions, suits, claims, demands, causes of action, proceedings, losses, costs, expenses, damages, liability, fines, or penalties arising directly or indirectly from the use of the premises, regardless of active or passive negligence or fault.
15. In the event of developing any medical problems after the date hereof, I undertake to consult a medical doctor for approval of my continued participation in MADFIT MMA endorsed exercises and training.
16. In the unlikely event of an emergency, I authorize transportation and licensed personnel to perform any necessary or advisable medical procedures and agree to bear the associated expenses.
17. As a visitor, I must adhere faithfully to the terms, conditions, rules, regulations, and safety regulations of the academy. This includes following the performance drills or techniques demonstrated, designed to develop your fighting skills/fitness. I further understand that all classes are supervised by qualified personnel and that strict observation of safety regulations will largely prelude the possibility of an accident and injury
18. DO NOT bring any dangerous materials, drugs, or weapons onto MADFIT MMA premises, which may put MADFIT MMA and its members at risk.
19. You may feature in videos and photos taken from time to time of MADFIT MMA training sessions, which will be published on our social media platforms for marketing and training purposes.

20. Regrettably, free trial bookings cannot be rescheduled. If circumstances prevent you from attending or require a change in the free trial date, please be advised that forfeiting the free trial will be necessary, and you will be required to enrol or pay for a drop-in class should you desire to proceed with training.
1. The Student acknowledges and fully understands the contagious nature of the novel coronavirus ("Covid-19"). The Student voluntarily assumes all risks associated with potential exposure to or infection by Covid-19, including the possibility of personal injury, illness, permanent disability, and death.
2. The Student specifically acknowledges that becoming exposed to or infected by Covid-19 at MADFIT MMA may result from the actions, omissions, or negligence of the Student and/or others, including but not limited to, any members, employees, volunteers, directors, or participants of or at MADFIT MMA.
3. The Student guarantees and affirms that they are currently free of any symptoms of Covid-19 and have not experienced any symptoms during the past 30 days. The Student confirms that they have not had a fever, dry cough, tiredness, aches and pains, sore throat, diarrhea, conjunctivitis, headaches, loss of taste or smell, a rash on the skin, or discoloration of fingers or toes, difficulty breathing or shortness of breath, chest pain or pressure, or loss of speech or movement in the last thirty days.
4. The Student voluntarily agrees to fully and solely accept and assume all risks and responsibilities associated with their attendance at MADFIT MMA or any participation in activities at MADFIT MMA. The Student hereby releases MADFIT MMA, its employees, trainers, and directors from any liability, responsibility, or claims, and waives any right to take any action or make any claim, including but not limited to claims for damages, costs incurred, or other related issues. The Student acknowledges and agrees to assume all risks, without reservation, whether a Covid-19 infection occurs before, during, or after participation.
5. The Student acknowledges that they are not authorized to take any photos, videos, audio recordings, or similar media of MADFIT MMA or while at MADFIT MMA. The Student agrees not to disclose to any person or party that they have trained at or with MADFIT MMA, or with any employees, trainers, or directors of MADFIT MMA. The Student shall treat any information related to MADFIT MMA, its employees, trainers, or directors, including discussions, as strictly confidential and shall not disclose such information. The Student acknowledges that any breach of this confidentiality obligation may cause irreparable harm and financial damage to MADFIT MMA, its employees, trainers, and directors, for which the Student will be held liable. These terms shall remain in effect until revoked in writing by MADFIT MMA.
6. No waiver of any terms and conditions of this agreement will be binding or effective unless expressed in writing and signed by MADFIT MMA. Any waiver shall be effective only in the specific instance and purpose given. No failure or delay by MADFIT MMA in exercising any right, power, or privilege under this agreement shall constitute a waiver. The Student is not entitled to assign, cede, delegate, or transfer any rights, obligations, shares, or interests acquired under this agreement without the prior written consent of MADFIT MMA. This agreement constitutes the entire agreement between the parties and supersedes any other representations, terms, or conditions relating to the subject matter. No variation, addition, deletion, or cancellation shall be effective unless reduced to writing and signed by the parties or their authorized representatives. If any provision of this agreement is held to be invalid, illegal, or unenforceable, it shall not affect the validity or enforceability of any other provision, and the agreement shall be construed as closely as possible to its original intent.

This membership cannot be transferred to anyone else.
You may not permit another person to use your membership rights and privileges.
South African Law governs this agreement, and you consent to the non-exclusive jurisdiction of the Cape Town Magistrates court in Cape Town in respect of any proceeding s arising out of this agreement.
You are obliged to furnish us with any changes you make / have to your personal details / banking / debit order details. By signing this agreement you bind yourself to the terms thereof.
